Terms of Use

1. Accepting these terms

These Terms of Use (“Terms”) are an agreement between you and Disco Beverage Inc. (“Robbie Dan’s”, “we”, “us”) governing your access to and use of robbiedans.com and its content (the “Site”). By entering the Site, confirming your age, or using any part of it, you accept these Terms and our Privacy Policy. If you do not accept them, do not use the Site.

2. Age requirement

The Site is intended solely for adults of legal drinking age in their jurisdiction of residence, which in the United States is 21 years or older.

• By entering you represent and warrant that you are of legal drinking age.
• You may not enter on someone else’s behalf, or share Site content with anyone under legal drinking age.
• You may not forward our marketing to, or repost our content for, an audience that is not predominantly of legal drinking age.
• We may refuse access to anyone we reasonably believe is underage.

Misrepresenting your age is a breach of these Terms and may be unlawful.

3. Permitted use

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to view the Site for your own non-commercial information, and to share links to it with other adults of legal drinking age. That licence ends automatically if you breach these Terms.

4. What you may not do

You agree not to:

• Use the Site if you are under legal drinking age, or help anyone who is to use it;
• Copy, reproduce, republish, frame, sell, licence or create derivative works from the Site or its content except as these Terms allow;
• Use our trademarks, logos, can artwork, photography or video without our prior written permission;
• Scrape, crawl, harvest, data-mine or use bots or automated means to access the Site, except for search-engine crawlers obeying our robots file;
• Use Site content to train a machine-learning or generative AI model without our written permission;
• Probe, scan or test the vulnerability of the Site, or breach or circumvent any security or authentication measure, including the age gate;
• Introduce malware, or interfere with or overload the Site or its infrastructure;
• Submit false, misleading or unlawful information, or impersonate anyone;
• Use the Site to send spam, or to promote alcohol to people under legal drinking age;
• Use the Site for any unlawful purpose, or in breach of any alcohol advertising or sale regulation;
• Remove or obscure any copyright, trademark or other proprietary notice.

5. Intellectual property

All content on the Site, text, photography, video, illustration, can and label artwork, layout, code, and the ROBBIE DAN’S name and logo, is owned by or licensed to Disco Beverage Inc. and protected by copyright, trademark and other laws.

Nothing on the Site grants you any licence or right to our intellectual property by implication, estoppel or otherwise. Third-party marks are the property of their owners.

6. Content you send us

If you send us feedback, suggestions, photographs, videos, reviews or other material (“Submissions”), you grant us a worldwide, perpetual, irrevocable, royalty-free, transferable, sub-licensable licence to use, reproduce, adapt, publish and display it in any media in connection with our business, without payment or attribution.

You confirm that each Submission:

• is yours, or you have all necessary rights and permissions to grant this licence;
• does not infringe anyone’s rights, including privacy, publicity and copyright;
• contains no one who appears to be under legal drinking age, and shows no irresponsible consumption;
• is not unlawful, defamatory, obscene, hateful or misleading.

We do not have to use, keep or return any Submission, and we may remove or edit it at any time. Do not send us confidential information, we cannot treat Submissions as confidential.

7. Orders and third-party sellers

We do not sell alcohol directly to consumers through this Site. Ordering links take you to independent, licensed retailers or fulfilment platforms.

• Your purchase is a contract with that retailer, on its terms, not with us.
• That retailer is responsible for pricing, taxes, payment, age verification at delivery, shipping, cancellations and refunds.
• Availability, price and shipping restrictions vary by state and change without notice. Nothing on the Site is an offer to sell where such an offer would be unlawful.
• An adult of legal drinking age must be present, and must show valid government-issued photo ID, to accept a delivery.

See Shipping & Returns for more detail.

8. Promotions, contests and events

Any sweepstakes, contest, giveaway or event we run is governed by its own official rules, published with that promotion. Where those rules conflict with these Terms, the rules control for that promotion. All promotions are limited to adults of legal drinking age, are void where prohibited, and are not sponsored or endorsed by any social media platform on which they may appear.

9. Trade inquiries

Course, distributor, retail and event inquiry forms are for licensed trade and authorised representatives. Submitting an inquiry creates no obligation on either side, and we may decline any inquiry. Any resulting supply relationship will be governed by a separate written agreement and by applicable alcohol beverage laws, including the three-tier distribution rules of the relevant state.

10. Third-party links

The Site links to third-party sites we do not control. Those links are provided for convenience only and are not an endorsement. We are not responsible for third-party content, products, practices or privacy handling. You visit them at your own risk.

11. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, timely, secure or error-free, or that any content is accurate, complete or current. Product specifications, availability and label information may change; the label on the can you hold governs.

Nothing on the Site is medical, dietary, legal or financial advice. Statements about our product have not been evaluated by any regulatory authority except as required for label approval.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER DISCO BEVERAGE INC. NOR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS OR LICENSORS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including for death or personal injury caused by negligence, or for fraud.

13. Indemnity

You agree to indemnify and hold harmless Disco Beverage Inc. and its officers, directors, employees and agents from any claim, demand, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, your Submissions, or your violation of any law or third-party right.

14. Governing law

These Terms and any dispute arising out of them are governed by the laws of the state in which Disco Beverage Inc. maintains its principal place of business, without regard to conflict-of-laws rules. This does not deprive a consumer of the protection of the mandatory law of their country of residence.

15. Dispute resolution

Talk to us first

Before starting any formal proceeding, please email hello@robbiedans.com with a description of the issue. Most things are fixable in a single email. We will try to resolve it informally within 30 days.

If that does not settle it

If we cannot resolve a dispute informally, either party may bring it before a court of competent jurisdiction. Either party may also bring a qualifying claim in small-claims court, and either may ask a court for injunctive relief to protect intellectual property.

16. General

• Changes. We may update these Terms. The “last updated” date shows the current version, and material changes will be notified on the Site. Continuing to use the Site means you accept them.
• Suspension. We may modify, suspend or discontinue the Site, or restrict your access, at any time without notice or liability.
• Severability. If a provision is held unenforceable, it is severed and the rest remains in force.
• No waiver. Failure to enforce a provision is not a waiver of it.
• Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition or sale of assets.
• Entire agreement. These Terms and the Privacy Policy are the entire agreement between us regarding the Site.
• Force majeure. Neither party is liable for failure to perform due to causes beyond its reasonable control.
• Export and sanctions. You may not use the Site in breach of US export control or sanctions laws.
